Understanding Title Insurance in Virginia

When purchasing a home in Virginia, you will encounter numerous documents and fees at the closing table. One of the most critical, yet frequently misunderstood, is title insurance.

 Unlike homeowners insurance, which protects you against future events like fire or storm damage, title insurance protects you against past events. It ensures that the person selling the home actually has the legal right to sell it to you, and that there are no undisclosed liens, judgments, or claims against the property.

 There are two types of title insurance: the Lender's Policy and the Owner's Policy. If you are financing your home, your mortgage lender will require you to purchase a Lender's Policy to protect their financial interest in the property. However, this policy does not protect you, the buyer.

 To protect your own financial investment, you need an Owner's Policy. This is a one-time fee paid at closing that provides coverage for as long as you or your heirs own the home. If a previous owner's unpaid contractor places a lien on the house, or if there is a dispute over property boundaries, your Owner's Policy covers the legal fees to resolve the issue. For a few hundred dollars at closing, it provides unparalleled peace of mind.
